The penalties for failing to report foreign assets can be draconian, and the circumstances giving rise to a reporting obligation are much broader than one would intuitively suspect. As such, every public tax practitioner needs an understanding of the what, when, and where of filing FBARS and other information returns related to ownership of foreign assets, including Forms 926, 3520, 3520A, 5471, 5472, 8865, and 8938. The presentation will focus on what must be reported on each form, when each form is required, and where to include the pertinent information on each of the forms. The presentation will also delve into recent cases regarding the foreign asses reporting requirements and taxpayer defenses to the penalties imposed for failure to properly report foreign assets.
